iwanted to address all of you on the news weve just announced. the board of directors and i have agreed to initiate a succession process for the ceo role of yahoo! roy bostock, our chairman of the board, is leading the effort to identify and assess potential candidates for consideration by the full board. the board will be evaluating and considering both internal and external candidates and has retained heidrick and struggles to help in this effort.
i will be participating in the search for my successor, and i will continue the ceo until the board selects a new ceo. once a successor is named, i will return to my previous role as chief yahoo and continue to serve as director on the board.
last june, i accepted the boards request that i assume the ceo role to restructure and reposition the company as a whole in order to effectively meet the fast -changing needs of both users and partners. since taking on the ceo role, i had an ongoing dialogue with the board about succession timing. thanks in large measure to your tireless efforts, we have created a more open, competitive yahoo! and we believe the time is now right to transition to a new ceo who can take the company to the next level.
despite the external environment we face, the fact remains that yahoo! is now a significantly different company that is

1987年1月，双方经过协商同意签定一份经营承包合同，发包方为××省××公司法人代表刘经理；承包人是公司职工靳××；承包期限规定从1987年1月至1990年1月。根据合同第六条经营自主权规定：包括业务经营权，财务管理权，劳动工资奖金分配权等。自合同生效后，月月有盈利，全体从业人员在奖金方面比过去得到了实惠。
但在本年10月，发包方以商店内有四名职工检举揭发承包人有经济和违反政策等问题，列举了我四条罪状，作出片面的处理决定，他们撕毁合同，解除我的承包人职务。对此，我申诉到上级省主管公司，未能合理解决，特依法提起诉讼。
首先，我对发包方对我作出的所谓四项经济问题和违反政策罪状的实际情况作以说明，供法庭查证参考，以便作出公正的裁判。
发包方处理的第一个问题是：“我用现金在商店套换转帐支票给个体户购买原料，给国家造成税收损失元”；
这一问题的实际情况是：我们承包合同第二条承包范围中（5）公司提供流动资金人民币叁万元（其中包括库存货物）。以此微薄地资金是不可能开展扭亏为盈的承包局面的，况且库存货物只有卖出后才能变成流动资金，如果减去货物价值，资金更少了。因此，我凭个人往来，从针织品个体户鲁××处借现金七万元，两个月后全部还清。我借入现金存入银行，有帐可据，但从银行再提出七万元现金还债是不可能的，因而只能用支票去还债。这有什么不对？我因公借款，以支票还债，这对税收有何损害？如有税务问题，为什么税务机关一直没来查处？因此，发包方说我以现金套换支票，这是得了便宜还骂人的不义之说，我不能接受。
第二个问题是：“代销商品不入库、不走帐，商品售出撕毁小票，范文《经营承包合同纠纷起诉状民事诉讼文书》。进销差款不入帐，并随意支出，违反了国家财经管理制度，影响了承包人、商店、及公司的利益。”
这个问题是带有历史性的，实际是：掌管这一代销业务的负责人是上任就负责此项工作的副经理王××。此人是前一任的副经理，我承包后原职不变。代销货进销差额保留在所谓“小金库”的事，都由王××专管，不是不入帐，也不是随意支出。这种“小金库”的收支直接和职工福利挂勾，是从我的前任到我经手一直由这个副经理王××专管。但在他检举了我之前，我问过他存多少钱？他说四、五百元。当他检举我之后，又说把钱给我了。向他要帐，说烧了。从这个经过看来，这个不光彩的“小金库”不是从我做起，更不是由我专管。这是沿袭下来的弊病。王××是沿续管理的人负责，请法庭详查。
第三个问题，说我虚报考勤套取工资，绝无此事。有考勤表可查，更有考勤员薛××可证，这个问题是强加于我的陷害。
第四个问题，说我用人不当，给商店人员思想造成混乱。这个问题才是主要的关键所在。自我承包后，经济搞活了，收支有盈余，职工资金增多，以王××为首的人既羡慕又嫉妒，这才出现排挤我的苗头。就在这承包的一年中，揭发检举我的四个人有三个人因犯错误被我调换了工作。
①刘××是收款员、承包后出问题，被我撤换了，其问题我已向公司作了汇报，调为营业员；
②阎××是营业员，因出问题被我调做收款员；
③刘×是出纳员，她是发包人刘×经理的妹妹，也因事故我准备调换工作，和她谈过就是这三个人加上上届的副经理王××，共同出头，向公司检举我，引起这个中途撕毁合同的事件发生。
对此，我认为发包方和上级主管公司，没有深入调查研究，主观作出决定是不对的。
当前在城市企业改革中，许多企业建立各种形式的经济责任制，订立生产经营承包合同，这是经济体制改革的新事物。它与经济合同有颇多相似之处。因此，《经济合同法》应当是调整这类经济关系，解决承包合同纠纷的主要依据。为此，请求法庭依照经济合同法的违约规定给予公平处理，是所至盼。
